Terms of Service

1. Who we are, what Backten is

Backten (“we”, “us”, “the platform”) operates backten.ph, a marketplace where sellers list pigs for sale and buyers find and contact them. Backten is a venue only. We do not own, breed, inspect, certify, or guarantee any animal listed on the platform, and we do not own or operate as any seller’s business.

2. Eligibility

You must be at least 18 years old to create an account, list an animal, bid, or transact on Backten — livestock trade involves binding contracts and money, and we do not extend that capacity to minors.

3. Venue-only, no money or animal custody

• Backten never holds, escrows, or processes payment for livestock sold between users. All such payments happen directly between buyer and seller, off-platform (cash, GCash, or another rail they agree on).
• Backten never takes custody, possession, or control of any animal listed on the platform.
• Every transaction is strictly between the buyer and the seller, at their own risk. Backten is not a party to it, does not mediate it, and is not responsible for its outcome.
• The subscription fee we charge sellers (see §6) is payment for access to the platform’s listing/auction tools — it is not payment for, or a guarantee of, any sale.

4. No verification of animals or listings

Listings are seller representations. We do not independently verify an animal’s health, weight, breed, age, or any other claim made in a listing. The “✓ KYC-verified” badge means we verified the account holder’s identity (see §5) — it is never an animal-health claim or a guarantee of listing accuracy. Buyers are strongly encouraged to inspect any animal in person before paying.

5. Identity verification (KYC)

Before bidding, messaging a seller, or publishing a listing, you must complete identity verification (government ID + live selfie). This exists to deter fraud, not to certify anything about you beyond “this account belongs to a real, identified person.” See our Privacy Policy for how we handle this data.

6. Subscriptions and payment

Seller subscription tiers, pricing, and the manual GCash/Maya/ GoTyme/bank-transfer payment-verification process are described on our Pricing page. Payments are reviewed and activated manually by the platform owner, typically within 24 hours. See our Refund Policy for cancellation and refund terms.

7. Prohibited conduct

• Posting fake, misleading, or duplicate listings.
• Requesting or sending payment for an animal never delivered, or any other conduct intended to defraud another user.
• Harassing, threatening, or impersonating another user.
• Attempting to circumvent KYC, reporting, or moderation systems.
• Listing species other than swine, or listing anything illegal under Philippine law.

8. Suspension, ban, and cancellation — owner discretion

We may suspend, soft-ban (hide from public search while you retain read access), hard-ban (block login, retain your data), or require cancellation of any account, at the owner’s sole discretion, with or without stated reason, effective immediately. This is necessary because fraud in a livestock marketplace moves fast and a slow, appeal-first process would leave other users exposed while we investigate. Our published Refund Policy governs what happens to any active subscription when this occurs, which is what makes this discretion fair to exercise. You may cancel your own account at any time.

9. Disclaimer of liability

To the maximum extent permitted by Philippine law, Backten and its owner disclaim all liability for: the condition, health, or legality of any animal listed; any user’s conduct, fraud, or breach of agreement toward another user; any loss arising from a transaction between users; and any indirect, incidental, or consequential damages arising from use of the platform. We provide the venue, the identity-verification layer, the logging/evidence-export tooling, and moderation — we do not guarantee any transaction’s outcome.

This disclaimer manages and reduces legal exposure — it does not make disputes impossible. Our strongest protection is structural: we never hold money or animals, and every account is identity- verified, logged, and moderated.

10. Indemnification

You agree to indemnify and hold Backten and its owner harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of the platform, your listings, your transactions with other users, or your violation of these terms.

11. Evidence and cooperation with authorities

We retain listing snapshots, chat logs, report history, and KYC decisions so that any party to a dispute can self-serve an Evidence Export to support a barangay complaint or court proceeding. We are not a party to, mediator of, or witness in user disputes beyond providing these records, and we respond to formal legal requests (subpoena, barangay or court order) as a neutral platform operator.

12. Changes to these terms

We may update these terms as the product and PH regulatory environment evolve. Material changes will be posted here with an updated effective date.
